Please take the time to thoroughly read these contract terms and conditions. By making a payment, you signify that you understand and agree to be bound by these terms, which together form the contract between Ombak Travel and you. Any alleged modification of these terms must be made in writing and signed by an Ombak Travel authorized signatory before it will take effect.

Agency: Ombak Travel only functions as an agent. On behalf of a number of transportation, lodging, and other service providers, including hotels and boat charter companies, we market a variety of travel-related goods. Ombak Travel’s responsibility is to book your travel on your behalf and to set up the necessary agreements between you and the providers of travel services. Ombak Travel is not accountable for these services and makes no guarantees or claims regarding their caliber. The terms and conditions and liability restrictions imposed by these service providers apply to all reservations. Legal action should be taken against the particular provider rather than Ombak Travel. Your remedy is against the travel service provider in question if it is unable to provide the services for which you have contracted.

Prices: All prices are based on availability and are subject to change or withdrawal without prior notice. Prices are typically given in USD. Until the complete amount is paid, exchange rates may fluctuate for reasons beyond our control. Before reservations can be completed, all deposits must be paid. By making a deposit, you agree to all of the terms and conditions. Full payment is required at least 90 days before to departure, though it may be earlier depending on the requirements of the various operators. Bookings made within 90 days must be paid for in full right away.

Cancellations by the client: All deposits are non-refundable. Please ensure you have the relevant travel insurance that may cover you in the case of unforeseen circumstances, including illness or accidents. Some cancellations may be partly refundable, but cancellation charges will apply. Ombak Travel is unable to provide any refund to you until we receive the funds back from the relevant supplier. Fees will also apply where a booking is changed or modified.

Force Majeure: Ombak Travel disclaims all responsibility for any damages, additional expenses, delays, itinerary changes, or trip cancellations brought on by Force Majeure. «Force Majeure» refers to any situation beyond Ombak Travel’s reasonable control and may include, but is not limited to, war or threat of war, riot, civil unrest, terrorist activity, industrial dispute, disease, pandemic (including any such future circumstances relating to the known COVID-19 pandemic), industrial or nuclear disaster, unsafe weather, tour operator cancellation of an event, government travel restrictions, fires, and strikes.

Travel Insurance: Personal travel insurance is mandatory as a condition of purchase for all Ombak Travel holiday packages. Travel Insurance is also deemed compulsory by many of our operators and partners. We also strongly recommend you also take out cover relating to COVID-19 circumstances and any increases in costs you may incur should your trip be postponed or canceled. It is your responsibility to ensure that you are adequately insured for the full duration of travel in respect of cancellation, illness, injury, death, loss of baggage and personal items, and cancellation and curtailment.

Taxes: Different nations have certain taxes that must be paid. At some airports, there might be an additional local tax. Without warning, all taxes are subject to change. Some reservations are subject to additional fees, especially those with stops in the USA. Taxes fluctuate daily and are subject to conversion using the rate of the date.

Health: It is your obligation to carry the appropriate immunization documents and to make sure you are informed of any health requirements for your trip destinations. Regarding the health criteria for your travel, you should speak with your doctor.

Passports & Visas: You have the responsibility of making sure that you have valid passports, visas, and re-entry permits that comply with immigration and other governmental laws. You will be solely liable for any fines, penalties, payments, or expenses incurred as a result of such documents failing to satisfy those authorities’ criteria. For overseas travel, every passenger must have a passport that is currently valid for at least six months after the intended entry date. Please contact us if you have any questions about the visa or other travel document requirements for your trip. On your behalf, we can collect this data from a third-party provider of visa consulting services. We make no guarantees as to the accuracy of such material and disclaim all responsibility for any loss or harm you may experience as a result of relying on it.

Best Price Guarantee — Terms & Conditions: Ombak Travel builds relationships with our surf experience operators to get you the best deal. It is a common misconception that it is always more expensive to book your holiday through a qualified agent — but at Ombak Travel, we don not charge booking fees, so there is no reason we wouldn’t have the same price or a cheaper price than any of our competitors for all surf experiences listed on our website. Prices available due to membership of a group or corporate entity or subscription to a closed group are excluded. Full group discounts cannot be applied to single bookings or groups that do not meet specified group number requirements. The quote must be in writing and must be presented to us prior to booking.

Liability: Ombak Travel disclaims any liability for the actions, inactions, or defaults of third parties over whom we have no direct control, whether in contract, tort (including negligence), or any other legal theory. In cases when culpability cannot be avoided, it is only ever worth what was paid for the travel arrangements. For any harm, damage, loss (including consequential loss), delay, additional cost, inconvenience, or loss of enjoyment caused directly or unavoidably indirectly by any event outside of our control and that cannot be avoided by our reasonable diligence, we do not accept any liability in contract, tort, or otherwise. Neither Ombak Travel nor any of its representatives accept any responsibility for oceanic occurrences or climatic conditions that do not match your expectations or are beyond your capabilities. All activities engaged in are solely at your own risk and of your own choice.

Privacy Policy: Ombak Travel is dedicated to maintaining the security and privacy of your personal data. Unless you give us permission to do so, Ombak Travel will not disclose any of your information to a third party. Prior to departure, all travel documents are sent electronically to the email address you specify at the time of booking.
